Live Auction Terms of Sale and Conditions
- Any employee of the city that was a party in the seizure or in any other way directly connected to the equipment and/or vehicle(s) to be sold or has non-public information about the equipment and/or vehicle(s), is prohibited from purchasing said equipment and/or vehicle(s).
- The successful Bidder shall remit payment during the duration of the live auction.
- Any and all purchased equipment and/or vehicle(s) must be removed by successful bidder within 3 business days; a $25 per day storage fee will apply after the fourth day.
- No pets will be allowed; service dogs only
- Registration from 7AM to 8:45AM; $20 registration fee
Condition of Sale
- The sale of City equipment and/or vehicle(s) is in an "AS IS" condition, with all faults and without warranty. The description of the equipment and/or vehicle(s) offered for sale has been compiled from data available. The City does not guaranty or warrant the condition or quality of the equipment and/or vehicle(s). The City reserves the right to withdraw any equipment and/or vehicle(s) being offered for sale. All costs associated with sale of the equipment and/or vehicle(s), including but not limited to loading, freight, insurance, shipping of equipment and/or vehicle(s) and taxes are the successful Bidder's responsibility. The sale of the equipment and/or vehicle(s) will be to the highest responsive and responsible Bidder. There shall be no refunds or adjustments on the successful Bidders price. All sales are final.
Omissions: The City is not responsible for any omissions, mistakes or errors in the description of the equipment and/or vehicle(s) offered for sale.
- The City reserves the right to withdraw any equipment and/or vehicle(s) from the sale up until the time the sale of the equipment and/or vehicle(s) have been awarded to the highest bidder. Award of Sale Item: A legally binding contract is established between the City and Bidder at the time auctioneer awards sale of equipment and/or vehicle(s) to Bidder. The City will pursue any and all legal remedies allowed by law against Bidder if Bidder fails to make any required payments. ALL SUBMITTED BIDS SERVE AS OFFERS TO FORM A CONTRACT.
Payment Terms
- Upon successful bid of the equipment and/or vehicle(s), the successful Bidder shall pay by cash, Cashier’s Check, Certified Check or Money Order made payable to the "City of San Luis" of the sale the successful bid amount. Personal checks will NOT be accepted
- Any and all purchased equipment and/or vehicle(s) must be removed by successful bidder with no debris or unwanted equipment and/or vehicle(s) left at the pickup location by Wednesday April1st, 2015 before 5PM. Any bidder who fails to remove all equipment and/or vehicle(s) within the specified period shall not be allowed to bid on future auctions
- Payments will be accepted from 9AM – 1PM during the auction on March 28th, 2015
Liability
- The successful Bidder shall assume all liability for the equipment and/or vehicle(s) after the award is made. The City is not responsible for any loss or damage to the equipment and/or vehicle(s) upon sale. The equipment and/or vehicle(s) shall not be removed from the possession of the City of San Luis prior to full payment.
