[ARCHIVED] Ordinance No. 336 “Don’t Text and Drive”

Unless using a hands-free system such as bluetooth, headphones or an affixed GPS system; the use of portable devices while moving in a vehicle or on a bicycle will be a citable offense. For purposes of informing and educating motorists who operate motor vehicles and or bicycles, any law enforcement officer may only issue verbal warnings for those violating this ordinance for a six-month period following the effective date of the ordinance. After the six-month period, violation of this ordinance will lead up to a fine of up to $100.00 and $250.00 if the person was found to be in a motor vehicle or bicycle crash. This will begin September 28, 2015 after the six-month educational period. Portable electronic device means a hand-held screen, mobile telephone to communicate by speaking or listening, or to communicate by writing, texting, or reading. Using a hand-held screen, or other hand-held electronic device to play a game, be connected to the internet, or otherwise view a hand-held screen can be a citable offense. Hand-held cell phone use is permitted in the event of an emergency such as calling 9-1-1. Even in an emergency situation, it is best to pull over and come to a complete stop before using or operating any mobile or hand held device.
